Consent Order Family Law

A consent order is a legally binding agreement that is signed by two parties to determine arrangements for both the care of children, and a division of assets and property after separation. If the consent order in question deals with asset division, it must set out the circumstances of the relationship including financial and non-financial contributions of the parties and their future.

If you’re looking for a lawyer that is trusted in consent order family law, Barton Family Lawyers are here for you. This information must be included in any application for consent orders for the division of property, so that the Court can make sure the division of property is fair or equitable in the circumstances.

Get in touch with our family law solicitors today by calling us on 3465 9332 or reaching out through our online form for more information.

Consent Order Family Law

Something to keep in mind is that a consent order is reviewed and approved only by a Judge or a Registrar and can equally be rejected by a Judge or Registrar if the consent order is drafted legally incorrect, if the consent order is not in the best interest of the children, or if the agreement is not fair and equitable in the circumstances. A consent order will not be made by a Court automatically.

Barton Family Lawyers are experienced in drafting fixed fee consent orders for our clients, ensuring it is done correctly and protects you in the future. The only difference between a consent order and a Court Order, is that you do not have to go to Court with a consent order.

The Benefits of Using a Consent Order Solicitor

Consent Orders Keep You Out of Court

When engaging a lawyer for consent orders through Barton Family Lawyers, you avoid having to go to Court to fight for what yourself and your former partner, and children, are needing. Using an experienced lawyer allows you to get through the legal process smoothly, and without added pressure or financial impact.

You Can Reach a Legal Agreement with Your Partner

A consent order allows yourself and your former partner to come to a mutual agreement that is enforceable legally, providing you both with peace of mind, confidence, and comfort knowing the outcome is within your interests, and your children’s best interests.

We Help Create Stability & Certainty

A consent order family law solicitor works alongside you and your former partner to provide and instill stability and certainty in relation to the care arrangements for children involved or in the middle of a separation.

Allows Each Party to Cut Financial Ties & Move on

This type of order allows financial ties to be cut between yourself and your former partner, allowing you both to move on with your lives financially in the way of formally agreeing on how to divide assets.

Assisting with Stamp Duty Exemptions on Transferring Property

It is financially beneficial to engage a consent order solicitor to do a consent order in comparison to paying stamp duty – with Barton Family Lawyers, you have the change to get an exemption from stamp duty if you are transferring property pursuant to the consent order, saving you and your former partner thousands of dollars.

Other Reasons to Consider a Consent Order:

  • To avoid conflicts and minimise the possibility of your former partner seeking to change the informal care arrangements of the children in future if/when circumstances change and the arrangement no longer suits them;
  • To minimise any possibility of your former partner seeking to change the care arrangements of the children in future;
  • It protects you in future from a claim by the other party against your post separation acquired assets (your assets acquired post separation are NOT protected without a consent order);
  • Only do a consent order if after legal advice you are confident it is in the children’s best interests and in relation to the division of assets, it must be an equitable agreement. The Court will not approve consent orders that are not just and equitable or which are not in the best interests of the children. The Court can also reject consent orders which are not drafted in a legally correct way.

Note that a Court will only allow you to change a final consent order with respect to the care arrangements of your children, if you apply to the Court and can satisfy the Court that there has been a significant change in circumstances since the order was made.
