What is Domestic Violence?
According to the Domestic and Family Violence Protection Act 2012, domestic violence is defined as violent behaviour by a person (the defendant) towards another when they have a domestic or family relationship. Domestic violence includes physical or sexual abuse, verbal abuse, emotional or psychological abuse, financial abuse and conduct that is threatening, intimidating, coercive, dominating, or controlling. What is a Domestic Violence Order and What Does it Do?
A Domestic Violence Order (DVO) is a protection order issued by a court that gives the respondent (the person who has committed domestic violence against you) a set of rules they must obey. A DVO is designed to keep you safe by placing your abuser under strict conditions, while inflicting harsh penalties upon them if they break these conditions. Our DVO lawyer will provide you with a strategy to maximise the prospects of your success in obtaining a DVO against the respondent to ensure your safety.
Who Can Apply for a Domestic Violence Order?
In order to apply for a protection order and for the behaviour to be considered domestic violence, the violence you have been exposed to must have occurred in any of the following relationships:
- An intimate personal relationship
- A family relationship
- An informal care relationship (for example, one person who is or was depending on another person for help with daily living activities where the person is not a paid carer)
What does the Court consider when determining whether to make an order?
The court needs to be satisfied that there has been domestic violence.
If the court is satisfied that family violence has been perpetrated, then the Court must determine whether an order is necessary and/or desirable to protect the aggrieved from the respondent.
In making this determination, the Court will consider the number of family violence incidents that have occurred, the frequency and severity of the incidents, and how long ago they occurred.
If the allegations that are made relate to incidents that occurred years ago, it is less likely the Court will find that an order is necessary and desirable.
If the allegations that are made relate to incidents that have occurred recently, it is more likely the Court will find that an order is necessary and desirable, because there is a greater risk to the safety of the aggrieved that she/he will be exposed to family violence again by the perpetrator in the future.
The Court takes into account coercive control, however in our experience, it depends on the Judge you get and how well educated they are in relation to the nature of coercive control and its impacts on the victim.
One incident of coercive control on its own may seem harmless, but if there are multiple incidents that have occurred over time, a pattern of behaviour is revealed.
The Courts have recently legislated to make coercive control illegal. This legislation will come into effect in May 2025.
With this legislative change it is hopeful that the Court will take more seriously incidents of coercive control when considering the necessary and desirability component.
